These terms govern use of novatheris.co.za. By using the website or submitting a form, you accept these terms and the privacy notice. If you do not agree, do not use the website.
1. Purpose of the website
The website provides general corporate, patient-orientation and professional-access information. It also provides a route for product safety and quality reporting. It is not an online pharmacy, public product catalogue, medical consultation, prescription service or emergency service.
2. No medical advice
Website content is general and cannot account for an individual’s medical history, examination, investigations, other medicines or risk factors. It must not be used to select a therapy, calculate or alter a dose, start or stop treatment, or delay professional care. A treating practitioner and the authorised product-specific information remain the proper sources for a patient’s treatment.
3. Regulatory status and access
The presence of a brand name, scientific category or general statement on this website is not evidence that a particular medicine or indication is registered, authorised, safe, effective, available or suitable. Regulatory status may differ by active ingredient, strength, dosage form, indication, patient and supply route.
An unregistered medicine may not lawfully be sold merely because it is requested or prescribed. Where registration or a SAHPRA authorisation is required, lawful supply is conditional on that status and all imposed conditions. NOVATHERIS reserves the right to withhold professional information or decline a request that cannot be fulfilled lawfully.
4. Professional applications
Applicants must provide true, current and complete information. Verification may include confirmation with the HPCSA, BHF/PCNS or another competent authority. Approval is discretionary and may be suspended or withdrawn.
Professional approval:
- is not HPCSA accreditation or regulator endorsement;
- does not expand a practitioner’s scope of practice;
- does not replace a dispensing licence or pharmacy channel;
- does not authorise the sale or use of an unregistered product; and
- does not create a supply contract or guarantee availability.
5. Orders and product information
Any lawful professional order, if accepted, is governed by separate account, prescription, dispensing, delivery, storage, pharmacovigilance and product-specific terms. The website does not itself accept or conclude a medicine sale.
6. Safety reports
Safety and quality reports should be factual and complete. Submitting a report authorises relevant follow-up and does not replace urgent medical care or a healthcare professional’s independent duty to report to SAHPRA. Reports may be shared with relevant supply-chain participants and regulators as permitted or required by law.
7. Third-party services
The website may open WhatsApp, an email application, the Information Regulator or another external service. Those services are governed by their own terms and privacy practices. A link does not amount to endorsement of unrelated content.
8. Intellectual property
NOVATHERIS names, logos, visual identity, copy and original website materials are protected by applicable intellectual-property law. They may not be copied, altered, republished, used on another product or used to imply affiliation without written permission. Fair quotation required by law is unaffected.
9. Acceptable use
You may not submit false professional details, patient information without authority, malicious code, automated spam, unlawful requests or content that infringes another person’s rights. Security controls may block or record suspected misuse.
10. Accuracy and availability
Reasonable effort is made to keep corporate information accurate, but content may become outdated and the website may be interrupted. Product-specific authorised information and written professional communications take precedence over general website copy.
11. Liability
To the maximum extent permitted by law, the website is provided without a guarantee that it will be uninterrupted or fit for a purpose not expressly stated. NOVATHERIS and Veridia are not responsible for loss caused by reliance on general website information as a substitute for medical advice, unlawful third-party conduct, unauthorised product supply or a user’s failure to follow product-specific instructions. Nothing in these terms excludes liability that cannot lawfully be excluded, including liability arising from gross negligence where exclusion is prohibited.
12. Governing law
South African law governs these terms. A dispute is subject to the jurisdiction of a competent South African court, without limiting any mandatory consumer or regulatory remedy.
